The Naval Air Systems Command Precision Strike Weapons Program Office (PMA-201) intends to procure by full and open competition evolutionary improvements to the performance characteristics of the FMU-139 electronic tail fuze (FMU-139D/B).

This is a DRAFT solicitation package which contains updates to previously provided information posted. 



WARNING: This procurement contains Technical Data subject to Export Control Laws. The Performance Specification, Serial Data Interface Control Document, Requirements Traceability Matrix, and  Plate, Identification, FMU-139D/B- 1379AS1003 Drawing are subject to Export Control Laws and must be requested by following the directions stated below.  The reference number is N00019-14-P1-AZ002.

The Government intends to conduct a pre-solicitation conference, tentatively scheduled for 17 July 2014.  The intent is for Industry to provide comments and recommendations with regard to the DRAFT solicitation package. Interested parties are encouraged to provide feedback in regards to conducting Oral Discussions, Section L, Part A, paragraphs 7.0 - 7.7 and to the Solicitation by using the attached Excel File entitled, "Sample Feedback Form."  The Government will post the date and time of the conference on FedBizOpps at least 14 calendar days prior to the conference.  Interested parties are requested to submit comments and recommendations by 14 July 2014, 3:00 PM EDT to Darla M Kelly at Facsimile (732) 323-7192 or e-mail at darla.kelly@navy.mil.

NOTICE OF FMU 139 d/B PRESOLICITATION CONFERENCE 
The US Naval Air Systems Command (NAVAIR), Program Executive Office (PEO) Unmanned Aviation and Strike Weapons (U&W), Precision Strike Weapons Program (PMA-201) anticipates awarding a Firm Fixed Price production contract, via Full and Open competition, in the 2QFY14 timeframe for evolutionary improvements to the performance characteristics of the FMU-139 electronic tail fuze.  This notice is intended to be used as an early exchange of information among industry and the program manager, contracting officer, and other participants in the acquisition process. Interested parties are encouraged to provide feedback in regards to conducting Oral Discussions, Section L, Part A, paragraphs 7.0 - 7.7 and to the Solicitation by using the attached Excel File entitled, "Sample Feedback Form",  to include any industry concerns or questions via a presolicitation conference.

The Presolicitation or preproposal conference is scheduled for 23 July 2014 in Lexington Park, MD.  Please also provide Ms. Darla M. Kelly with the list of attendees via the attached sample attendee form ("Sample Attendee Form.xlsx").  A meeting agenda, including each offeror's one-one meeting with Government, will be provided via e-mail several days prior to this event.  Offerors are advised to print out documentation provided, as the Government will not be providing any printed material.  Directions to meeting place will be provided at the same time.

Pursuant to Federal Acquisition Regulation (FAR) 15.201(c), this notice is being issued as a notice of Presolicitation conference.  THIS IS NOT A REQUEST FOR PROPOSAL.  IT DOES NOT CONSTITUTE A SOLICITATION AND SHALL NOT BE CONSTRUED AS A COMMITMENT BY THE GOVERNMENT.  RESPONSES IN ANY FORM ARE NOT OFFERS AND THE GOVERNMENT IS UNDER NO OBLIGATION TO AWARD A CONTRACT AS A RESULT OF THIS ANNOUNCEMENT.  No funds are available to pay for preparation of responses to this announcement.  Any information submitted by responders to this presolicitation conference is strictly voluntary.  The Government is not obligated to and will not pay for any information received from potential sources as a result of this notice.  The information provided herein is subject to change and in no way binds the Government to solicit for or award a contract.

The following changes have been made to the posted draft solicitation.  The price ranges may also be updated. 



Under Section B, B-3 Pricing Note has been updated;



B-3 NOTE 1 Determination of Applicable Pricing Ranges (Revised 7/1/2014)

(a)  Because CLINs 0101/0102, 0201/0202, 0301/0302 and 0401/0402 contain the same fuze, to achieve economies of scale, the Government will combine the individual quantities of each pair of CLINs and the total quantity of both CLINs will be used to determine the pricing range under B-2 Pricing Ranges for both CLINs.  For example, if the Government wanted to order 15,000 of CLIN 0101 and 3,000 of CLIN 0101, the individual quantities would be added (15,000 + 3,000 = 18,000) and the pricing range for 18,000 in Table 3 would be used for the unit price of 15,000 of CLIN 0101 and the pricing range of 18,000 in Table 4 would be used for the unit price of 3,000 CLIN 0102.



(b)  Additionally, the Government shall have the right to modify any delivery order(s) within 90 days of issuance (within each ordering period) to increase the quantity and revise the respective unit prices and total prices based on the combined quantity ordered.  The revised unit prices and total price shall be based upon the prices set forth in the B-2 Pricing ranges for the total quantifies ordered as modified for each item ordered.  For example, if 60 days after the award of the delivery order for the quantities in the prior paragraph, the Government wanted to add an additional 10,000 units of CLIN 0101, the new combined total would be 28,000 (15,000 + 3,000 + 10,000 = 28,000) and the pricing range for 28,000 in Table 3 would be used for the unit price of the 25,000 units of CLIN 0101 and the pricing range for 28,000 in Table 4 would be used for the unit price of the 3,000 units of CLIN 0102. 



Under Section H, the following has been added;



H-1  Orders to Fulfill Foreign Military Sales Commitments (JUL 2014)

(a)  The Government may place orders for the items under this contract to fulfill foreign military sales commitments.

(b)  On the date the order is placed, the Government shall identify the foreign country for the purpose of negotiating any equitable adjustment attributable to foreign military sales.  Failure to agree on an equitable adjustment shall be treated as a dispute under the Disputes clause of this contract.
